Waiver

Effective 8/14/26

By signing this agreement, I acknowledge and agree to the following terms and conditions related to participation in activities, programs, services, and use of the facility at FUNdamentals, LLC, located at 1365 Wampanoag Trail, Riverside, RI 02915.

 

Assumption of Risk

I understand that participation in activities, programs, services, and use of the FUNdamentals facility—including, but not limited to, climbing, sliding, jumping, running, movement activities, use of play equipment, and interacting with other children—involves inherent risks of injury, illness, property damage, and other hazards. I voluntarily assume all risks, known and unknown, associated with the use of the Fundamentals, LLC play facility, equipment, amenities, and surrounding areas, for myself and the minor child(ren) listed below. I affirm that both I and the listed child(ren) have the physical ability and health to safely participate in the activities offered and understand that Fundamentals, LLC does not screen or assess participants for fitness or ability.

 

Release of Liability

I, on behalf of myself and the minor child(ren) listed below, and our respective heirs, legal representatives, executors, administrators, and assigns, hereby fully and forever release and discharge Fundamentals, LLC, its members, employees, officers, directors, associates, volunteers, and insurers from any and all claims, causes of action, liabilities, costs, expenses, or demands—whether known or unknown, anticipated or unanticipated—arising directly or indirectly out of participation in activities at, on, or about the Fundamentals, LLC facility. This release includes, without limitation, any claims for personal injury, illness (including communicable disease), emotional distress, property loss or damage, and death, and it expressly includes claims of negligence, whether active or passive, on the part of Fundamentals, LLC, to the fullest extent permitted by law.

 

Rules & Conduct

I acknowledge that I have received, read, and agree to comply with all posted and communicated rules and policies of Fundamentals, LLC. I further agree to ensure that the minor child(ren) listed below also comply with all rules and safety guidelines.

I understand that failure to follow posted or verbal instructions may result in immediate revocation of access to the facility without refund or credit.

I further acknowledge that Fundamentals, LLC reserves the right to require any guest to leave the premises immediately if they engage in unsafe, disruptive, or inappropriate behavior, including but not limited to yelling, screaming, aggressive physical contact, hitting, or any conduct that jeopardizes the safety, comfort, or well-being of others.

 

Supervision and Responsibility

I understand and agree that:

• During Open Play, FUNdamentals, LLC does not provide direct supervision of participating children. A responsible adult age 18 or older must remain on the premises and actively supervise their child(ren), including maintaining appropriate awareness of their child's location, behavior, and safety.

• During scheduled classes, therapy services, tutoring, camps, programs, or other staff-led activities, supervision and participation requirements may differ. Parents/caregivers agree to follow the supervision, drop-off, pick-up, and participation requirements communicated for the specific service or program.

• Parents/caregivers remain responsible for providing accurate and relevant information regarding their child's needs that may affect safe participation.

• FUNdamentals, LLC is not responsible for lost, stolen, or damaged personal property while in or around the facility, including the parking lot or vehicles.

   

Medical Treatment Authorization

In the event of an emergency, I authorize Fundamentals, LLC staff to administer or seek emergency first aid or medical care for myself or the child(ren) listed below if deemed necessary. I waive any claim arising from such care and agree that all terms of this agreement remain in full effect under those circumstances.

 

Parental Authority and Minor Participation

I certify that I am the parent or legal guardian of the child(ren) listed below and have full legal authority to sign this agreement on their behalf. I assume all responsibility for any misrepresentation of my relationship to the child(ren) or for attempting to admit a minor not listed below. This waiver applies to all minors under my supervision while at, on, or about the facility.

 

Waiver of Future Protections and Claims

I expressly waive any rights or protections under laws that may limit the enforceability of this agreement, including any law that might allow for the preservation of unknown claims. I understand that this agreement applies to current and future visits and participation at FUNdamentals unless it is replaced by an updated agreement or revoked in writing.

 

Severability

If any portion of this agreement is found to be invalid or unenforceable, the remaining terms shall remain in full force and effect.

 

Acknowledgement and Acceptance

I have read and understand this Waiver, Release, and Assumption of Risk Agreement in its entirety. I am freely and voluntarily signing this document and agree that it shall remain valid unless revoked in writing by me.
